Article 1 - Purpose
The present General Conditions of Sale have for object, on the one hand, to inform any potential consumer on the terms and conditions in which the seller ("BINET-PAPILLON")  proceeds to the sale and to the delivery of the ordered products and, on the other hand, to define rights and obligations of the parties in connection with the sale of the products of BINET-PAPILLON to the consumer ("Buyer"). Consequently, the fact that any person orders a product offered for sale on the BINET-PAPILLON website implies full and complete acceptance of these General Terms of Sale which the Buyer acknowledges having read prior to ordering.
The products are offered for sale and free delivery in metropolitan France for all orders greater than or equal to 50€ and with shipping costs that are displayed after validation of your cart for any other destination.
For the purposes of these General Terms and Conditions of Sale, the Buyer and BINET-PAPILLON are individually or collectively referred to as the Party or Parties.
The Buyer prior to his order, declares that:
the purchase of products on the website BINET-PAPILLON has no direct relationship with a professional activity and is limited to a strictly personal use ;
have full legal capacity, allowing him to engage in under these conditions of sale.
BINET-PAPILLON sells the products present on its Internet Site only at retail and to final consumers. Any order that does not clearly correspond to a retail sale and, more generally, any order that is fraudulent or presumed to be fraudulent, will be considered by BINET-PAPILLON as null and void.

Article 3 - Contract and Orders
3.1 Rates
The sales prices of the products online on the website BINET-PAPILLON, quoted in euros, are those in effect at the time of registration of the order by the Buyer. The selling price of products can be modified by BINET-PAPILLON at any time. This change will be reported to the Buyer before any order.
Shipping charges are shown before the validation of the order by the Buyer.
For metropolitan France, the shipping costs are free from 50€ in the cart and for Europe, from 100€. For the rest of the world, shipping costs are calculated for each destination and are displayed before payment validation.
Prices include French Value Added Tax (VAT), applicable at the date of the order and any change in the rate applicable will be reflected in the price of the products sold by BINET-PAPILLON in its Website.
3.2 Characteristics of the products
In accordance with Article L. 111-1 of the consumer code, the Buyer may, prior to his order, read on the BINET-PAPILLON website, of the essential characteristics of the product(s) he wishes to order.
The Buyer may select one or several products among the various collections offered on the BINET-PAPILLON website.
The products offered and presented by BINET-PAPILLON are valid while stocks last.
BINET-PAPILLON may modify at any time the range of products offered for sale on its website, without prejudice to the orders placed by the Buyer.
3.3 Order
Any order implies acceptance to these Terms and Conditions Sale, without prejudice to any specific contractual conditions concluded between the Parties.
The Buyer has the option to verify the details of its order and to correct any errors. From the moment the Buyer confirms his order by clicking on the "validate" button, it is regarded as having knowingly accepted these General Conditions of Sale, prices, volumes and quantities of products offered for sale and ordered by the Buyer.
The order validated by the Buyer will be confirmed to him by BINET-PAPILLON. The sale will be considered final only after the last provision of this order confirmation to the Buyer by BINET-PAPILLON and receipt by the brand BINET-PAPILLON of the integrality of the price.
BINET-PAPILLON recommends to the Buyer to keep the information contained in the order confirmation sent by BINET-PAPILLON on paper or on a digital document.


Article 4 - Payment
Payment must be made at the time of the online purchase by the Buyer. At no time, the sums paid cannot be considered as a deposit or down payment. All orders are payable in euros, including all taxes and compulsory contributions.
To pay his order, the Buyer can use the following payment methods: credit card and Paypal account.
The bank cards accepted on the BINET-PAPILLON website are those accepted by their secure financial partners, in particular Stripe and Paypal.
BINET-PAPILLON vouchers are not valid at BINET-PAPILLON retailers.
The Buyer guarantees to BINET-PAPILLON that he has the necessary authorizations to use the method of payment which he will have chosen for his order, at the time of the recording of his purchase order.
BINET-PAPILLON reserves the right to suspend or cancel any execution of a command and / or delivery, whatever its nature and runlevel, in case of default in payment or partial payment of any sum payable by the Buyer, in case of an incident of payment or in case of fraud or attempted fraud concerning the use of the Website BINET-PAPILLON .
Penalties in an amount equal to the statutory interest rate plus five points are fully legally applicable to amounts outstanding at the end a period of ten days following the settlement date or upon notification of rejection of bank payment for any other means of payment. The delivery of any new order may be suspended if late payment or partial payment of a previous order and this notwithstanding the provisions hereof.
BINET-PAPILLON  reserves the right to request a photocopy of the identity card and / or if the credit card (front only) of the Buyer for any payment by credit card.
As part of the fight against Internet fraud, the information about your order may be sent to any third parties authorized by law or designated by BINET-PAPILLON  solely for verification of the identity of the Buyer to the validity of control method of settlement used and planned shipment.
To ensure the security of credit card payment, the Buyer shall transmit to the agency online payment chosen by BINET-PAPILLON  the security code (CVV) on the back of the bank card used by the Buyer.

Article 5 - Delivery and reception
5.1 Conditions of Delivery
5.1.1 General rules
The products subject to a final order of the Buyer will be delivered to the shipping address provided by the Buyer on his order.
By default, the invoices are sent by email at the e-mail address indicated by the Buyer when registering on the Site BINET-PAPILLON.
Failure to comply with contractual conditions described below, any claim by the Buyer shall not be accepted.
5.1.2 Characteristics of delivery (excluding purchase of samples and discovery sets)
At the delivery and if you are present, the carrier will give you your parcel in person. In case of absence, the Buyer or the recipient of the order will receive a notice of passage, allowing him to withdraw the ordered products at the nearest pick-up point indicated in the notice of passage, during a period of fifteen days.
The Buyer or the consignee of the ordered products is invited to check the apparent condition of products upon delivery.

5.2 Delivery
For all orders confirmed from Monday to Friday (excluding public holidays) on the BINET-PAPILLON website, the order will be prepared on the same day or the following day, subject to availability, i.e. dispatch usually on D+2.
Then there are the delivery times, which for France only (no guaranteed delivery times for international orders) are as less than or equal to 5 working days.
In the event that the delivery time exceeds 7 days and is not due to force majeure, the Buyer may cancel the order by registered letter with acknowledgement of receipt addressed to BINET-PAPILLON - Cancellation Service - Galerie Vivienne - 5, rue de la Banque - 75002 Paris - France, or by email: contact@laboratoire-ids.com
BINET-PAPILLON will then proceed to an investigation with the carrier concerned prior to the reimbursement of the undelivered ordered products.
The Buyer may exercise this right to cancel its order for failure to deliver within the contractual period, within a maximum period of sixty working days from the exceeding of the maximum period indicated for the delivery of products. The total of the sums paid by the Buyer will then be restored to him if the entirety of the order is returned, in the form of a credit note or refund, at the choice of the Buyer, as soon as possible and at the latest within thirty days following the date on which the Buyer exercised his right to obtain the cancellation of his order.
5.3 Delivery Issue
Once the package is handed over to the carrier, the carrier is the guarantor of the goods. In the event of delivery issues (parcel not received), the Buyer should  contact the carrier in order to file a claim with their Services.
BINET-PAPILLON  can in no case be responsible in case of dispute with the carrier concerning a delivery issue.


Article 6 - Right and withdrawal period
In accordance with Article L. 121-20 of the Consumer Code, the Buyer has a period of 14 (fourteen) clear days from the date of receipt of his order by himself or by the recipient of the order, to return at his expense the entirety of his order and obtain, at the Buyer's choice of exchange of products, or a credit note or a refund corresponding to the amount of his order, excluding shipping costs.
The products must be returned to BINET-PAPILLON  according to the procedures described in Article 7 - below.


Article 7 - Back products
The products supplied may be returned by the Buyer to BINET-PAPILLON  in the terms and instructions detailed below. The products must be returned to BINET-PAPILLON  in perfect condition for resale or in their original state (Packaging, accessories, instructions ...)
7.1 Return by parcel or by mail
BINET-PAPILLON accepts the return by parcel or by mail of any product purchased on https://binet-papillon.com/ if it is returned to BINET-PAPILLON within 14 (fourteen) days from the date of receipt of the order by the Buyer.
The shipping costs of the return package remain the responsibility of the Buyer, except in case of lack of conformity of the delivered products with the order.
In case of exchange of product(s), the costs related to a new delivery of products are charged to the Buyer.
To return a product, the Buyer must follow instructions following:

BINET-PAPILLON does not accept parcels sent with postage due. Any risk related to the return of the product is the responsibility of the Buyer.


Article 8 - Retention of title
BINET-PAPILLON retains full ownership of products sold until full payment is received in full, in principal, fees, taxes and mandatory contributions included.


Article 9 – Liability
BINET-PAPILLON cannot be held responsible for any indirect damage which could occur because of the purchase of the products. In the same way, the responsibility for BINET-PAPILLON under the obligations of the present General Conditions of Sale could not be committed in the event of occurrence of an event of absolute necessity as defined by the French courts.


Article 10 - Non-partial validity
If one or more stipulations of the present General Terms and Conditions of Sale are held to be invalid or declared as such in application of a law, a regulation or following a final decision of a competent court, the other stipulations shall retain all their force and their scope.


Article 11 - No Waiver
The fact that one of the parties does not avail itself of a breach of any of the obligations referred to in these general conditions of sale shall not be interpreted for the future as a waiver of the obligation in question.


Article 12 - Applicable law and jurisdiction
Sales of products of the company BINET-PAPILLON are subject to the French law. Any dispute relating to the existence, the interpretation, the execution or the rupture of the contract concluded between BINET-PAPILLON and the Buyer, even in the event of plurality of defendants, will be, in the absence of amicable agreement, of the exclusive competence of the courts of Auch.


Article 13 - "Data Protection"
The personal data collected by BINET-PAPILLON at the time of any order of the Buyer are necessary to manage his order by BINET-PAPILLON and its suppliers and could be used, subject to the rights exercised by the person concerned, in order to inform this person of the products or services provided by BINET-PAPILLON and / or its trading partners.
